Agreement to Terms

By accessing the website holistic4spirit.com or using any services provided by Holistic4Spirit ("Practice," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

Services Provided

Holistic4Spirit provides aesthetic treatments, holistic wellness services, naturopathic consultations, and related services at 102 E Victoria Ct A, Greenville, NC 27858. Services are provided by Elena Y. Davis, ND, a licensed naturopathic doctor and esthetician. All services are provided within Elena's scope of practice as authorized by applicable North Carolina law and her professional licenses.

Our services are not a substitute for emergency medical care. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.

Appointments and Cancellation Policy

• Booking: Appointments may be booked online, by phone at (252) 916-9462, or in person.
• Confirmation: You will receive an email and/or SMS confirmation upon booking. Please review your confirmation for accuracy and contact us immediately with any discrepancies.
• Cancellations: We require at least 24 hours notice to cancel or reschedule an appointment without penalty.
• Late cancellations: Cancellations made less than 24 hours before your appointment may be charged the full service amount, in addition to forfeiture of any deposit paid.
• No-shows: Clients who do not attend a scheduled appointment without notice may forfeit their deposit and may be required to prepay for future appointments.
• Rescheduling: You may reschedule your appointment up to 24 hours before your scheduled time via the link in your confirmation email or by calling us.
• Practice cancellations: In the rare event we must cancel your appointment, we will provide as much notice as possible, and any deposit paid will be fully refunded.

Deposits and Payments

• Deposits may be required to secure certain appointments, as indicated at the time of booking.
• Deposits are non-refundable regardless of how much notice is given.
• Payment is due at the time of service unless other arrangements have been made in advance.
• We accept major credit cards, debit cards, gift cards, and cash.
• Payments are processed securely through Stripe. We do not store full card numbers.
• Prices are subject to change. Quoted prices are valid at the time of booking.

Gift Cards

• Gift cards are valid for 2 years from the date of purchase.
• Gift cards are non-refundable and may not be exchanged for cash.
• Gift cards may not be used to purchase other gift cards.
• Lost or stolen gift cards will not be replaced without proof of purchase.
• Gift card programs may not be used in connection with referral incentives in a manner that violates applicable anti-kickback laws.

Membership terms, pricing, benefits, and cancellation policies are described in full on our Memberships page. By enrolling in a membership, you agree to those terms, which are incorporated herein by reference.

Medical Disclaimer

The information on this website is for general informational purposes only and does not constitute medical advice. Naturopathic consultations and aesthetic treatments provided by Elena Y. Davis, ND are conducted within her scope of practice as licensed in North Carolina. Nothing on this website creates a physician-patient relationship.

Results from aesthetic treatments vary by individual. We make no guarantees of specific outcomes. Before-and-after images, if displayed, represent individual results and are not a guarantee of results for any other client.

You are responsible for disclosing all relevant medical history, medications, and conditions to Elena prior to any treatment. Failure to disclose relevant information may affect the safety or efficacy of your treatment and releases us from liability for any adverse outcomes directly resulting from undisclosed information.

Informed Consent

Prior to receiving certain treatments, you will be asked to sign an informed consent form. By signing, you acknowledge that you have been informed of the nature of the treatment, potential risks and benefits, alternatives, and the right to refuse treatment. Informed consent is obtained for each new treatment type.

Photography and Images

We may request to take before-and-after photographs for clinical documentation purposes. Clinical images are maintained as part of your health record and governed by our HIPAA Notice. We will not use your images for marketing without your separate written consent.

Website Use

• You must be at least 18 years old to use our website and services without parental or guardian consent.
• You agree not to use the website for any unlawful purpose or in any way that could harm us, other users, or third parties.
• You agree not to attempt to gain unauthorized access to any portion of our website or systems.
• You may not reproduce, copy, or distribute any content from this website without our express written permission.

Intellectual Property

All content on this website — including text, images, logos, design, and code — is owned by or licensed to Holistic4Spirit or CTE Studios and is protected by applicable intellectual property laws. CTE Studios retains ownership of the platform technology and design. The Holistic4Spirit brand and service content belongs to Elena Y. Davis.

Limitation of Liability

To the fullest extent permitted by North Carolina law, our total liability for any claim arising from your use of our website or services shall not exceed the amount you paid us for the specific service giving rise to the claim in the three months preceding the claim.

We are not liable for indirect, incidental, consequential, punitive, or special damages. Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages — in such jurisdictions, our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Holistic4Spirit, Elena Y. Davis, ND, and CTE Studios from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of our services or violation of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Pitt County, North Carolina. You consent to the personal jurisdiction of such courts.

Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on our website with reasonable notice. Your continued use of our website or services after the effective date of any change constitutes acceptance of the new Terms.
